Avoiding Lengthy Court Battles
Arbitration can be used to settle issues that cannot be resolved through negotiation or mediation. It is an alternative to the court systems when you are considering a divorce. Arbitrators are neutral, impartial decision makers similar to judges.
Unlike mediators, arbitrators decide cases and both parties are bound by the decision. If you and your spouse agree on arbitration as the right way to settle the issues that you cannot agree upon, you must abide by the arbitrator’s decisions and their imposed settlements.
The Arbitrator will render decisions based on the facts of the case and the law in Ontario.
It is easier to set a date for arbitration and sometimes it is less formal than a trial in court.
For issues that cannot be resolved with mediation or negotiation, an arbitrator can make the decisions - which will be binding as agreed to before the arbitration begins.
Arbitration is usually much quicker and can be less expensive than going through a trial using the court system in Ontario.
It can be less adversarial and less stressful for the family than a prolonged court battle. Arbitration hearings are scheduled according to the needs of the parties and their lawyers. The proceedings themselves are confidential, although if the arbitrator’s decision is appealed, the issues can become public knowledge in a court of law.
If arbitration is a viable option for your situation, you will want an arbitrator who is professional and experienced. The arbitrator should be seen by both parties as competent, impartial and diligent. The arbitrator should be well versed in Ontario arbitration procedures and practices, and in family law in Ontario.
